2 Application of the terms and conditions

An order placed by the Customer implies they accept all the present terms and conditions.

3 Validity of our offers

Our offers are intended solely for consumers with a delivery address in Albania, Andorra, Belarus, Bosna i Hercegovina, Bulgaria, Croatia, Cyprus, Estonia, Hungary, Iceland, Ireland, Kosovo, Latvia, Lithuania, Macedonia, Malta, Moldova, Montenegro, Norway, Romania, Russian Federation, Serbia, Slovenia and Ukraine.
Items displayed on the site are available until depletion of stock.
In the event of debit or payment of an order for an item which is unavailable, SPARTOO.EU will inform the Customer by email and offer a credit note or refund within 15 days.
SPARTOO.EU will inform the Customer by email if the order contains an item which is not available.

4 Presentation of products

All products for sale are described and presented as accurately as possible.
However, SPARTOO.EU cannot be held responsible for any errors or omissions which may occur in this presentation.
The photos supporting the product information are non-contractual.

5 Prices

Prices are in Euros inclusive of VAT for Albania, Andorra, Belarus, Bosna i Hercegovina, Bulgaria, Croatia, Cyprus, Estonia, Hungary, Iceland, Ireland, Kosovo, Latvia, Lithuania, Macedonia, Malta, Moldova, Montenegro, Norway, Romania, Russian Federation, Serbia, Slovenia and Ukraine. If the VAT has been modified, these changes may have an impact on the price of our products, without the customer having been informed beforehand. SPARTOO reserves the right to modify its prices at any moment, but the products are invoiced at the price indicated when the order is registered.

6 Order and Secure Payment

6.1: Payment

First-time customers will be required to fill out a form containing the following information : title, first name, surname, complete delivery address, email, date of birth, and telephone number. The customer also creates their password at this time.
After clicking on the "Pay Securely Now" icon and verifying the details of their order (colour, amount, size, price, etc…), the customer confirms their order by entering in their payment details.
If the client benefits from a special offer, he/she should enter the code that was previously attributed to them in the space provided.
Customers may pay with their debit, credit card, or via Paypal directly on the website. Once they have chosen the desired payment method and clicked on "Confirm", the client confirms definitively and irreversibly their order. Your order confirmation means you accept the present Terms and Conditions.

We accept the following payment methods:

  • Payment by Credit or Debit card
    The client verifies their delivery address, the products, and the total price. He or she provides the number of the credit or debit card with the expiry date and CCV code. He or she irrevocably validates the order by clicking on the button «Confirm».

  • Payment in 3 instalments
    It is possible to pay in three monthly payments. One third of the total will be debited immediately, the second third one month after the purchase date and the remaining third will be debited two months after the purchase date.
    This method of payment can be chosen directly on the payment page, by clicking on the button “Other Methods of Payment”.
    This service costs an additional 5€, and is only available for orders of 50€ or more. This 5€ service charge is not refunded if the order is returned.

  • Paypal
    With PayPal your financial information is never communicated to SPARTOO.EU. PayPal encrypts and protects your card number once and for all. Pay online by simply indicating your PayPal email address and password.

  • Payment on delivery
    Pay for your order in cash upon delivery. We do not accept cheques. If the purchaser does not make payment when the goods are delivered, then the goods will be returned to the seller. This service costs an additional 7.50€. This 7.50€ service charge is not refunded if the order is returned.

  • Bank transfer
    Pay for your order by transferring your payment directly from your bank. Your order will be shipped once your payment is received by SPARTOO. Please allow for up to 4 working days from the date you transfer your payment for Spartoo to receive your payment. If your payment is not received within 14 working days, your order will automatically cancelled.

6.2: Payment Default

SPARTOO.EU reserves the right to refuse to carry out a delivery or to honour an order placed by a customer that has not totally or partially paid a preceding order or with whom a payment dispute is being handled.

6.3 : Payment Verifications

SPARTOO.EU monitors all the orders that have been confirmed on the website, and all payments made to SPARTOO will be subject to security checked from both the card provider and SPARTOO.EU. This monitoring aims to protect SPARTOO.EU from abusive practices operated by a fraudster and to product our customers against unauthorised use of their payment details.

Our services might ask you to provide additional information to unblock your order : proof of address or of a debit in your name, or proof of address in the name of the person indicated for the delivery address, etc...

In order to ensure secure payments, SPARTOO.EU uses the secure payment service provided by CIC bank (a leading French bank). This service utilises the SSL security standard. Confidential data (16-digit bank card number as well as expiry date, security code) are encrypted and sent directly to the bank server without passing through the physical SPARTOO.EU server.
When the order is validated:
The payment request is routed in real-time to the secure remote payment manager.
This asks for an authorisation request from the bank card network.
The remote payment manager issues an electronic certificate which is proof of the amount and the date of the transaction in compliance with stipulations of articles 1316 and following of the French civil code.

8 Sign up / Sign in

All customers who have already made a purchase at SPARTOO.EU can choose a password which will allow them to place subsequent orders without having to complete the required information forms again.
The Customer who has already subscribed is recognised on the site as being a customer at SPARTOO.EU.
The SPARTOO.EU customer's password is strictly confidential and personal.
It must never be disclosed to a third party.
In the event the SPARTOO.EU customer has lost or has forgotten his/her password, he/she should contact SPARTOO.EU customer service at this address info@spartoo.com and a new password will be issued within 48 hours to replace the previous one.
In order to facilitate the identification of the Customer by provision of both the e-mail address and password, the Customer expressly authorises SPARTOO.EU to place a "Cookie" on the customer's computer with the sole purpose of facilitating the above-mentioned identification.

9 Delivery operated by Spartoo

Delivery times given are in reference to the order date, and presented in working days (Saturdays, Sundays and bank holidays are not taken into account for calculation of delivery time). The delivery times are calculated according to your delivery address. In case of force majeur, Spartoo.eu can not be held responsible for any delay in delivery.

10 Money-back guarantee

All items purchased at SPARTOO.EU may be exchanged, free of charge, for another size or a refund. To be accepted, returns should meet the following conditions:
- The product should not have been worn outside. It should be in new condition
- Should be returned in the original packaging and in good condition
- The product should be returned within 30 days of delivery of your order
- Follow the indicated return procedure

10.1 : The return options are the following:

Free returns for Albania, Andorra, Belarus, Bosna i Hercegovina, Bulgaria, Croatia, Cyprus, Estonia, Hungary, Iceland, Ireland, Kosovo, Latvia, Lithuania, Macedonia, Malta, Moldova, Montenegro, Romania, Serbia, Slovenia and Ukraine by UPS.
Free returns does not apply to Norway, or the Russian Federation.

10.2 : The return procedure is as follows:

Step 1: Customer Account
Sign in to your Spartoo customer account with your email address and your password and go down to the section "my returns" to complete a return request.

Step 2 : Receive label
- If your return is pre-paid by Spartoo: you'll receive an email with a link that you can click on to print out your shipping label.

Step 3 : Give the return parcel to the transport service
Give your parcel to the pre-selected transport service if your return has been pre-paid, or to the transport service of your choice if the return is at your charge.
Please remember to keep your proof of postage receipt.

11 Delivery and despatch problems

These are consignments which have not been delivered to the final destination for the following reasons: Undeliverable, not claimed, refused, damaged in transit, opened...

11.1: Returned as "UNDELIVERABLE":

Consignments returned to Spartoo by the transporter with the following remark: Undeliverable. Once we have received and accepted the undelivered consignment, SPARTOO.EU will contact the customer to propose a new shipment if the product is still available or to offer a refund.
SPARTOO.EU reserves the right to reimburse an order and not to re-ship it if multiple "UNDELIVERABLE" orders have been identified.

11.2: Returned as "NOT CLAIMED":

Consignments which have not been claimed by the customer within the time limit imposed by UPS.
Once we have received and accepted the undelivered consignment, SPARTOO.EU will contact the customer to propose a new shipment if the product is still available or offer a refund.
SPARTOO.EU reserves the right to reimburse an order and not re-ship it if multiple " NOT CLAIMED" orders have been identified.

11.3: Returned as "REFUSED":

The consignment has been refused during delivery attempt. Once we have received and accepted the undelivered consignment, a credit note will put in the customer account within 72 hours following receipt of the undelivered consignment. The Customer may request a refund and thus cancellation of the credit note directly in our " CUSTOMER SERVICE " section .

11.4 : "DELIVERED" by courier:

The courier claims to have delivered your consignment, either by having a proof of delivery receipt with the customer's signature, the signature of someone in the customer's household, or a neighbour, or the courier claims to have left the consignment in a safe place on the customer's property.

In the event that the consignment cannot be found, a lost parcel claim form will need to be requested from the customer service centre either by email or by telephone. All lost parcel claims forms must be sent to the following address:

Once we have received your signed and dated claims form by post, your claim will be processed and either a refund will be processed or a replacement will be shipped, depending on the customer's wishes and available stock.

In the event a consignment is returned to Spartoo as " UNDELIVERABLE ", "NOT CLAIMED ", or "REFUSED", SPARTOO.EU cannot guarantee reservation of the ordered items and may need to reimburse the order if the product(s) is/are not available.

12 Responsibility

For all stages - from access to the site, browsing, filling in forms, placing an order, delivering items or any other service, SPARTOO.EU only has a reasonable endeavours obligation. SPARTOO.EU cannot be held responsible for any inconvenience or damages arising from the use of the Internet outside the diligence and precautions taken by SPARTOO.EU. In particular, SPARTOO.EU cannot be held responsible for any disruption of service or any external intrusion or presence of a computer virus. Similarly, any event which qualifies as force majeure in the legal sense by the French Court of Appeals fully exonerates SPARTOO.EU from all responsibility. Customers benefit from guarantees offered by the brands listed on the site.

13 Intellectual Property

All elements on the SPARTOO.EU site, visual or audio, including the underlying technology, are protected by copyright, brand and patent law.
They remain the exclusive property of SPARTOO SAS.
All hypertext links forwarding to SPARTOO.EU and in particular use of framing, deep-linking, in-line linking or any other deep linking technology is strictly prohibited.
In all events, any link, even authorised, must be removed when requested by SPARTOO SAS.

14 Personal Data

SPARTOO.EU, in the interest of the service, reserves the right to collect personal data about site users, in particular using "Cookies" as stipulated in article 8. For this, the SPARTOO.EU site is registered with CNIL under the number: 1182432. SPARTOO.EU also reserves the right to use data collected on the site for commercial purposes. In all cases, and in compliance with French law n°78-17 of January 6 1978, any user or customer of the site may, at any time, competition with the commercial use of this data and also has rights to access, rectify and delete their personal data.

15 Games and Competitions

Competitions organised by SPARTOO.EU are free to enter, purchase is not required. They are open to all residents of the following countries: Albania, Andorra, Belarus, Bosna i Hercegovina, Bulgaria, Croatia, Cyprus, Estonia, Hungary, Iceland, Ireland, Kosovo, Latvia, Lithuania, Macedonia, Malta, Moldova, Montenegro, Norway, Romania, Russian Federation, Serbia, Slovenia and Ukraine.
Winners of competitions will be informed by e-mail which will contain their prize in the form of a code for a discount or gift voucher from SPARTOO.EU. This single-use voucher can be used throughout the site, excluding promotions and may not be combined with other special offers.
Excluding special promotions, money-off vouchers are valid for three months and gift vouchers for one year.
If the amount of the gift voucher exceeds the value of the order placed by the Customer, the balance will be transferred to the gift voucher account. It will automatically be proposed during a future order on the "Payment" page.
If the amount of the gift voucher is less than the value of the order, the Customer must complete payment by bank card.
SPARTOO.EU never discloses participants' names and e-mail addresses.
By providing their e-mail address, participants automatically agree to receive the spartoo.eu newsletter
SPARTOO.EU reserves the right to postpone or cancel competitions and cannot be held responsible for any problem which may arise during the operation.
Taking part in the competition implies full agreement with these rules.
The rules may be modified at any time by the organiser, in compliance with the expressed conditions.
Fraud or attempted fraud for personal gain may lead to prosecution.

16 Private Sales

Products presented in "SPARTOO.EU private sales" are available to all those who meet at least two of the following conditions:
-They are a customer at SPARTOO.EU having opened an account on the site with a valid e-mail address and password
-They have received an invitation by e-mail sent to the account address
-They have received at least one e-mail from SPARTOO.EU

17 Gift cards and money-off vouchers

Gift cards and money-off vouchers are non-refundable and have no monetary value. However, products purchased using vouchers and coupons may be returned for an exchange, or a credit note if the items are no longer in stock.
